Effective March 25, 2019, a 15-Day notification (previously 2-Days) has to be submitted to the Tennessee Department of Environment
& Conservation (TDEC) prior to all Inspections/Risk Assessments/Clearances
and All Lead Abatement Activities (Removal, Replacement, Encapsulation and
Enclosure). Note: Notification requirement is 15 “calendar
days” not “working days.”
The Notification of Lead-Based Paint Activity form is a critical component that allows program administrators to:
- Evaluate or inspect LBP activity performed by certified professionals to ensure proper application of work-practice standards,
- Confirm the prevalence of lead in housing stock, and
- Identify where LBP abatement may occur, the 2-Day Notification Waiver is being rescinded.
The 15-Day notification requirement for LBP Inspections/Risk Assessments/Clearances may be waived in the future, on a case-by-case basis.
Impacts: Potential delays of sale transactions and construction/renovation/abatement projects, as well as potential fines from the state of Tennessee if regulations are not followed.
